Terms of Service

Effective and last updated: November 4, 2026.

Version: 2026-11-04.1

These terms govern your use of the hitPDX website, iPhone and Android apps, and related features (the “Service”), provided by Cool S, LLC (“we,” “us,” or “our”). By using the Service, you agree to these terms. If you do not agree, stop using the Service.

1. Eligibility and accounts

You must be at least 13 and meet any higher minimum age required where you live. If you are under the age of legal adulthood, your parent or legal guardian must review and agree to these terms and permit your use. If you use the Service for an organization, you must have authority to bind it. Event age limits and admission rules apply separately.

Keep account information accurate and protect your sign-in methods, devices, recovery codes, and private calendar links. Tell us promptly about unauthorized access. You are responsible for activity you authorize. Guest access may be lost when cookies are cleared or sessions expire; saved events and preferences are not a permanent backup.

2. Event information and third parties

hitPDX helps you discover events. We do not organize, operate, supervise, or sell admission to events merely because we list them. Listings, source links, and recommendations do not mean we endorse an event, organizer, venue, or seller, or have verified its safety, legality, accessibility, or suitability for you.

Information comes from third parties and automated processing, including artificial intelligence. Listings may be incomplete, duplicated, outdated, or wrong. Dates, prices, locations, categories, age guidance, availability, and cancellation status may change. Check the organizer’s official information before paying, traveling, or attending. A “free,” family, or accessibility label is not a guarantee. Recommendations are not professional advice.

Third-party websites, ticket sellers, maps, sign-in providers, and other services have their own terms and privacy practices. Purchases, refunds, admission, and event disputes are between you and the relevant provider. We do not control their conduct or performance. You decide whether to attend and are responsible for evaluating the ordinary risks of travel and participation and following venue rules.

3. Reminders, calendars, and availability

Saves do not reserve admission. Reminders, calendar exports, location results, and cancellation alerts are conveniences and may be delayed, inaccurate, or never delivered. Devices, permissions, networks, and third-party services affect delivery. Do not rely on them as your only notice of a change or as a safety or emergency service. Your carrier’s data charges may apply.

We may change, limit, suspend, or discontinue features or the Service. We do not promise uninterrupted access, support, or indefinite storage. Where reasonably practicable, we will give advance notice of a material reduction or shutdown and an opportunity to export your account data, subject to security and legal requirements.

4. Permitted use

Subject to these terms, you may use the Service for lawful event discovery and personal planning. We grant a limited, nonexclusive, nontransferable license to use our apps on devices you own or control, subject to applicable app-store rules. Open-source components remain subject to their own licenses.

  • Do not violate the law or others’ privacy, intellectual property, or other rights.
  • Do not impersonate others, commit fraud, send spam, or submit malicious material.
  • Do not access another person’s account, bypass access controls or rate limits, interfere with the Service, or overload its infrastructure.
  • Do not bulk extract, resell, or redistribute the Service or its protected content without permission, except as applicable law or an express license permits. This does not restrict ordinary search-engine indexing, authorized calendar subscriptions, or your use of unprotected event facts obtained lawfully.

5. Content, feedback, and privacy

We and our licensors retain rights in the Service’s software, branding, design, and original content. Third-party names, materials, and trademarks belong to their owners. These terms do not give us ownership of underlying event facts or give you rights to third-party materials.

You retain ownership of material you submit. You give us permission to use it only as needed to operate and improve the Service and respond to you. You must have the rights needed to submit it. We may use voluntary suggestions without payment or an obligation to implement them. Our Privacy Policy explains how we handle personal data; these terms do not expand those permissions. Report incorrect listings or rights concerns using the contact below, with the relevant URL and details so we can investigate.

6. Fees and app stores

hitPDX is currently free to use. These terms do not authorize a charge or subscription. If we offer paid features, we will disclose the price and payment terms and obtain your agreement before charging you. Third-party event charges are separate.

Apple and Google do not operate hitPDX or organize the events it lists. App-store terms also apply to downloads and purchases. For an iOS app obtained through Apple, Apple’s Standard Licensed Application End User License Agreement governs the app license, and these terms govern the Service. Nothing here overrides app-store usage rules or rights under that license.

7. Warranty disclaimer

To the fullest extent the law allows, the Service is provided “as is” and “as available.” We disclaim express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, and noninfringement. We do not warrant that the Service or its information will be accurate, complete, secure, available, or error-free. No information or advice from us creates a warranty unless we expressly agree in writing.

8. Limits on liability

To the fullest extent the law allows, Cool S, LLC and its personnel and suppliers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or lost profits, revenue, opportunities, goodwill, or data arising from the Service or these terms, even if advised that such losses were possible. Our total aggregate liability arising from the Service or these terms will not exceed the greater of US $50 or the amount you paid to Cool S, LLC for the Service in the 12 months before the event giving rise to the claim. These limits apply regardless of the legal theory of a claim.

These exclusions and limits do not apply to fraud, gross negligence, willful misconduct, death or personal injury caused by our negligence, or any liability that cannot legally be excluded or limited. Mandatory consumer rights and remedies remain intact. Where a limitation is not permitted, it applies only to the extent the law allows.

9. Misuse and third-party claims

If you use the Service on behalf of a business or organization, to the extent permitted by law, that business or organization agrees to indemnify Cool S, LLC and its personnel for third-party claims and reasonable legal costs caused by its unlawful use of the Service, infringement of others’ rights, or material breach of these terms. This does not cover our own wrongdoing. We will give prompt notice of a claim and a reasonable opportunity to participate in its defense; no settlement may impose an obligation or admission on you without your consent. This section does not apply to individual consumers using the Service for personal purposes.

10. Ending access

You may stop using the Service at any time and export data or delete your account in Account. We may restrict or end access for material or repeated violations, security risks, harm to others, or legal requirements. Where reasonably practicable and lawful, we will explain the reason and give you an opportunity to address it. Contact us if you believe we made a mistake. Provisions concerning ownership, liability, third-party claims, and disputes survive termination where needed to give them effect.

11. Disputes and general terms

Oregon law governs these terms, excluding conflict-of-law rules. Unless mandatory law allows otherwise, disputes belong in the state or federal courts serving Multnomah County, Oregon, and each party consents to their jurisdiction. You may bring an eligible claim in your local small-claims court. Any mandatory protections and rights to sue in your home jurisdiction remain available. These terms do not require arbitration or waive class actions. You may contact us to try to resolve a concern informally, but doing so is not a prerequisite to exercising your legal rights.

These terms and any separately agreed feature-specific terms form our agreement about the Service. If a provision is unenforceable, the rest remain effective. Failure to enforce a provision is not a waiver. We may transfer this agreement with a merger, reorganization, or sale of the Service, without reducing your rights under it.

Cool S, LLC respects copyright. Send copyright complaints, including notices under the Digital Millennium Copyright Act (DMCA), to [email protected]. Identify the specific hitPDX listing or link so we can locate it. Other questions and listing corrections can go to the general contact below.

A notice of claimed infringement should include:

  1. Your physical or electronic signature as the owner or an authorized representative.
  2. The copyrighted work, or a representative list of works at a single online site.
  3. The material or link you want removed and information sufficient to locate it, such as its hitPDX URL.
  4. Your contact information, including mailing address, telephone number, and email.
  5. A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner of the allegedly infringed exclusive right.

We respond expeditiously to notices that substantially meet the applicable legal requirements by removing or disabling access to the identified material or link. We may request missing information. We may also remove material when we otherwise learn of infringement. We terminate, in appropriate circumstances, subscribers and account holders who are repeat infringers, and accommodate and do not interfere with standard technical measures as defined by the DMCA.

Counter-notices

If we remove material you supplied at your direction and you believe the removal was a mistake or misidentification, you may send a counter-notice to the copyright email above. Include your physical or electronic signature; identification of the removed material and its former location; a statement under penalty of perjury that you believe in good faith it was removed through mistake or misidentification; and your name, address, and telephone number. You must also state that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, any judicial district where Cool S, LLC may be found), and will accept service of process from the original complainant or their agent.

Where the DMCA counter-notice procedure applies, we promptly forward a valid counter-notice to the complainant and explain that we will restore access in 10 business days. We restore access between 10 and 14 business days after receiving it unless we first receive notice that the complainant filed an action seeking a court order to restrain the infringement. Notices and counter-notices may be shared with the affected parties. Knowingly making material misrepresentations can result in liability under the DMCA. This process does not determine whether a use is lawful.

13. Updates and contact

We may update these terms prospectively by posting a revised version and effective date. For material changes, we will provide reasonable advance notice in the Service or by email, except where urgent legal or security changes require a shorter period. Changes will not retroactively alter an existing dispute. Continued use after the effective date means you accept the revised terms; if the law requires express consent, we will seek it. If you disagree, stop using the Service.
